PC §25400 makes it illegal to carry a concealed firearm without a valid permit. It's generally a misdemeanor — up to 1 year county jail and a $1,000 fine — but becomes a straight felony under several aggravating factors.

Felon In Possession: Penal Code §29800

PC §29800 prohibits anyone with a prior felony conviction from owning, purchasing, or possessing a firearm. This is a straight felony regardless of the circumstances of possession.

What Makes PC §25400 A Felony

A prior felony or firearm conviction, a stolen firearm, active gang membership, or being otherwise prohibited from possessing a firearm all convert this from a misdemeanor to a felony filing.

A Mandatory Minimum Applies To Repeat Offenders

PC §25400 carries a mandatory minimum 3-month jail sentence for anyone with a prior felony or gun-crime conviction — 3 to 6 months if that prior conviction was itself firearm-related.
